The VA can reexamine your disability rating 6 months after leaving active-duty service or between 2 and 5 years from the date you were granted disability benefits. VA disability law follows strict guidelines about rating reductions, and per the Code of Federal Regulations, it may only reduce your rating after:
- The VA has reviewed the veteran’s entire medical history.
- The veteran undergoes a thorough examination that is adequate for rating purposes.
- The VA finds sustained improvement in the veteran’s ability to function under the ordinary conditions of life, including employment.
If you fail to appear at your reexamination session, the VA has the right to automatically reduce or terminate your rating.
